Terms of Service & User Agreement

Welcome to Tenant Peace (“Tenant Peace,” “we,” “us,” or “our”). Tenant Peace provides a platform for tenants to share their personal experiences with landlords and rental properties. By creating an account or accessing or using the Tenant Peace website, mobile applications, or other services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by the following Terms of Service and User Agreement (the “Agreement”).

1. Acceptance of Terms

1.1 Binding Agreement. By using Tenant Peace, you agree to be legally bound by this Agreement, our [Privacy Policy], and the Community Guidelines (collectively, the “Policies”).
1.2 Updates. We may update or modify these Terms of Service at any time. Any changes will be effective immediately upon posting. Your continued use of the Services after such posting constitutes your acceptance of any changes.

2. Eligibility

2.1 Age Requirement. You must be at least the age of majority in your place of residence (18 in most states within the U.S.) to use Tenant Peace.

2.2 Authority. You represent and warrant that you have the full legal authority to enter into this Agreement.

3. Description of Services

3.1 Platform for User-Generated Content. Tenant Peace is a user-generated content platform where individuals can submit fact-based reviews of their personal experiences with landlords.

3.2 No Brokerage or Agency. Tenant Peace is not a real estate broker, real estate agent, rental agency, or legal advisor. We do not endorse or verify the accuracy of user content.

3.3 Review Process. Tenant Peace may review submitted content to remove personal identifying information of landlords or to ensure compliance with our Policies, but we do not guarantee comprehensive monitoring.

4. User Content

4.1 Ownership and License. You retain ownership of any text, photographs, or other materials you submit (“User Content”). By submitting User Content, you grant Tenant Peace a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, display, distribute, and create derivative works of your User Content for the purpose of operating, improving, or promoting our Services.

4.2 Accuracy of Information. You agree that all information you submit is true, accurate, factual, and not misleading. You represent that you have proof (such as a lease or other documentation) to confirm your tenancy at the property being reviewed.

4.3 Prohibited Content. You shall not submit any content that is defamatory, harassing, hateful, discriminatory, obscene, invasive of privacy, infringing on intellectual property rights, or otherwise illegal. See our Community Guidelines for more detail.

5. Privacy and Personal Identifiers

5.1 Prohibition on Posting Personal Data. You must not post personal data (e.g., full names, phone numbers, email addresses) that could identify a landlord or any other individual.

5.2 User Verification. You may be required to provide proof of tenancy or identity (e.g., uploading a copy of your lease or a valid ID). Tenant Peace may request additional proof for verification but does not guarantee or assume responsibility for the authenticity of that proof.

6. Moderation, Flagging, and Takedown

6.1 Community Moderation. Tenant Peace reserves the right (but has no obligation) to remove, block, or modify User Content that violates our Policies, is flagged by other users, or for any reason at our sole discretion.

6.2 Flagging Mechanism. Users may flag content they believe is in violation of our Policies for review. Tenant Peace will evaluate flagged content and take appropriate actions, which may include removal of the content or suspension of the offending user’s account.

6.3 No Guarantee. While Tenant Peace monitors content to some extent, we are not liable for any content that remains on our platform or for any delay in removing offending material.

7. Intellectual Property

7.1 Tenant Peace IP. All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, the “Tenant Peace IP”) is owned or licensed by Tenant Peace. You have no right to use Tenant Peace IP for any purpose without our express written permission.

8. Disclaimers and Limitations of Liability

8.1 Section 230 (U.S.). Tenant Peace is a provider of interactive computer services under Section 230 of the U.S. Communications Decency Act. We are not the publisher or speaker of any User Content; users are solely responsible for the content they post.

8.2 No Warranty. Tenant Peace provides the Services on an “as is” and “as available” basis without any warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8.3 Limitation of Liability. To the maximum extent permitted by law, Tenant Peace, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services.

8.4 Content Disclaimer. Tenant Peace does not guarantee the accuracy, completeness, or usefulness of any User Content and does not adopt, endorse, or accept responsibility for the accuracy or reliability of any statement made by third parties.

9. Indemnification

You agree to defend, indemnify, and hold harmless Tenant Peace and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Services, (b) your User Content, (c) your breach of this Agreement, or (d) your violation of any third-party right, including intellectual property, confidentiality, property, or privacy right.

10. Dispute Resolution

10.1 Governing Law. This Agreement shall be governed by and construed under the laws of the State of Virginia, without regard to its conflict-of-law principles.

10.2 Arbitration. Any dispute arising out of or relating to this Agreement shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Fairfax County, Virginia, and the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

10.3 Injunctive Relief. Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

11. Termination

We reserve the right to suspend or terminate your account or your access to the Services at any time for any or no reason, including violation of this Agreement or the Community Guidelines.

12. Miscellaneous

12.1 Entire Agreement.This Agreement, together with the Community Guidelines and any other policies referenced herein, constitutes the entire agreement between you and Tenant Peace.

12.2 Severability. If any portion of this Agreement is found to be invalid or unenforceable, that portion will be severed, and the remaining provisions will remain in full force and effect.

12.3 No Waiver. The failure of Tenant Peace to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

Community Guidelines

Tenant Peace strives to maintain a respectful, informative, and helpful community for all users. By participating on our platform, you agree to abide by the following Community Guidelines:

1. Respect for Others

  • Civility: Treat all users with respect and courtesy. Avoid personal attacks, name-calling, trolling, or abuse.
  • Inclusivity: Respect that others may have different perspectives. Harassment or discrimination based on race, ethnicity, nationality, religion, gender, orientation, or disability is strictly prohibited.
  • Privacy: Do not post any personal information about another individual (landlord, tenant, or otherwise) that could identify them (full name, address, phone number, email address, etc.).

2. Quality of Content

  • Fact-Based Discussions: Share information based on personal experience and factual events rather than hearsay or unverified rumors. Defamatory, indecent, offensive, profane, discriminatory, misleading, or threatening comments are not allowed.
  • No Spam or Promotion: Do not spam the platform with off-topic posts, irrelevant links, or promotional materials for commercial or personal gain.
  • No Fraud or Deception: Avoid posting any content that is fraudulent, deceptive, or intentionally misleading.

3. Prohibited Activities

  • Coordinated Attacks: Coordinated or mass attacks on specific landlords, tenants, or users are prohibited.
  • Illegal Content: Any content that promotes illegal activities, including but not limited to scams or harm to others, is forbidden.
  • Impersonation: Impersonating another user, landlord, tenant, or a representative of TenantPeace is not permitted.

4. Moderation and Enforcement

  • Flagging Content: If you see content that violates these Guidelines or our Terms of Service, please flag it for review.
  • Removal and Bans: Tenant Peace reserves the right to remove any content that violates these Guidelines and to ban repeat offenders without warning.
  • Appeals: If you believe your content was removed or your account was suspended in error, you may contact us to request a review.

By participating on Tenant Peace, you agree to comply with these Community Guidelines. Thank you for contributing to a positive, respectful, and informed community.
